Form 17 in Washington: the seller disclosure timeline

Form 17 — the Seller Disclosure Statement required under RCW 64.06 — is one of the few documents in a Washington transaction with a hard statutory clock and a buyer termination right attached. Mishandle the timing and you can hand the buyer a clean exit well after mutual acceptance. Here's the timeline that actually matters.

What it is

Form 17 is the seller's written disclosure about the condition of the property — water, sewer/septic, structural, systems, environmental, and known defects. The residential version is Form 17; the commercial equivalent is 17-C. It is a disclosure, not a warranty, but an inaccurate or omitted disclosure is where post-closing disputes start.

The two clocks

  • Delivery: the seller delivers Form 17 to the buyer within 5 business days of mutual acceptance (unless the parties agree otherwise).
  • Rescission: upon receipt, the buyer has 3 business days to rescind based on the disclosure — in writing — and recover the earnest money.

Both are business-day counts, so weekends and Washington state holidays don't count. The rescission clock runs from receipt, which is why documenting the delivery date matters — a fuzzy delivery date means a fuzzy (and longer) termination window.

The exemptions

Not every transaction requires Form 17. Common exemptions under RCW 64.06 include certain new-construction sales, foreclosure/trustee sales, and some transfers between co-owners or family. Even when exempt, sellers still can't affirmatively conceal a known material defect. Whether an exemption applies to a specific deal is a legal question — route it to the broker or an attorney rather than assuming.

Why it bites

The classic failure is treating Form 17 as paperwork to chase “eventually.” If it slips past the 5-business-day mark, or the delivery date isn't documented, the buyer's rescission window stays open longer than anyone realizes — and a buyer with cold feet near inspection will use it.
